1. Acceptance of Terms
By accessing or using the services of Shubhakamana Securities Pvt. Ltd. (Broker #71, NEPSE), you agree to be bound by these Terms of Use. If you do not agree, please do not use our services or website.
2. Services Provided
Shubhakamana Securities provides stock brokerage services authorized by the Securities Board of Nepal (SEBON) and depository participant services registered with CDS & Clearing Limited. Our services include the buying and selling of securities listed on NEPSE, DEMAT account management, and related financial services.
3. Client Responsibilities
Clients are responsible for providing accurate and complete information during account opening and KYC processes. You are responsible for maintaining the confidentiality of your TMS login credentials and Mero Share password. Any trading activity conducted through your account is your sole responsibility. You must notify us immediately of any unauthorized access to your account.
4. Investment Risk Disclaimer
Investing in the stock market involves risk. The value of investments can go up or down, and past performance is not indicative of future results. Shubhakamana Securities does not guarantee any returns on investments. All investment decisions are made at the client's own risk. We recommend consulting a qualified financial advisor before making investment decisions.
5. Brokerage Fees and Charges
Brokerage commission rates are set in accordance with SEBON and NEPSE regulations. All applicable fees, taxes (including DP charges and capital gains tax where applicable), and levies will be deducted from your account as per prevailing rules. Clients will receive contract notes detailing all charges for each transaction.
6. Limitation of Liability
Shubhakamana Securities shall not be liable for any losses arising from market fluctuations, system downtime, delays in order execution due to technical issues at NEPSE or TMS, or actions taken based on market information provided on our website. Our liability is limited to the brokerage fees charged for the specific transaction in dispute.
7. Governing Law
These Terms of Use are governed by the laws of Nepal. Any disputes arising from the use of our services shall be subject to the jurisdiction of the courts of Kathmandu, Nepal, and the regulatory authority of SEBON.
8. Amendments
Shubhakamana Securities reserves the right to amend these Terms of Use at any time. Continued use of our services after any changes constitutes acceptance of the revised terms. We will notify clients of significant changes via email or notice on our website.
